TERMS & CONDITIONS BETTEREARTHFLOWERS.COM.

PLEASE READ THE FOLLOWING TERMS & CONDITIONS. BY ACCEPTING THE FOLLOWING TERMS AND CONDITIONS YOU ACCEPT AND WARRANT THAT YOU ARE CURRENTLY AT LEAST 18 YEARS OLD, OR OVER THE AGE OF EIGHTEEN (18), ARE CAPABLE AND HAVE FULL AUTHORITY TO USE A VALID CREDIT CARD, AND ARE CAPABLE OF LAWFULLY ENTERING INTO THE TERMS AND CONDITIONS OF THIS AGREEMENT. GUARANTEE, DISCLAIMERS AND LIMITATION OF LIABILITY.
BETTEREARTHFLOWERS.COM guarantees that fresh cut flowers are purchased directly from FAIR TRADE CERTIFIED farms in Colombia, Ecuador, Africa, or wherever the FAIR TRADE certified grower may be located, as per TRANSFAIR USA RULES AND REGULATIONS, and that 10% additional of the F.O.B. US Dollar value charged to BETTEREARTHFLOWERS.COM by the FAIR TRADE Certified grower for these flowers, is paid directly to the workers of the farms that participated in the production, packing and marketing of these flowers, to be used by them solely in social, educational, or health projects, in compliance with the rules that regulate each of these FAIR TRADE Certified farms, as regulated by the Fairtrade Labeling Organizations (FLO) & TRASFAIR USA. BETTEREARTHFLOWERS.COM also guarantees that if an online shopper decides to make a free willing donation to the workers of any of the FAIR TRADE Certified farms working with BETTEREARTHFLOWERS.COM, BETTEREARTHFLOWERS.COM, will send 100% of the funds donated to the workers of the farm, or farms that the donor wishes to contribute to, after contacting the donating individual for advice as to the farm or original location where he wishes to donate to. BETTEREARTHFLOWERS.COM guarantees that all cut flowers will be sent fresh, to the appointed address of delivery, directly from one of the FAIR TRADE certified farms working with BETTEREARTHFLOWERS.COM. If you are not entirely satisfied with the quality of the flowers sent to the appointed address of delivery BETTEREARTHFLOWERS.COM will either replace the flowers purchased with an identical arrangement or replace the arrangement with one that has flowers equivalent in cost, or color, to the ones purchased originally, and if not available, with flowers of similar value to the ones originally purchased as soon as is reasonably possible. In any case, if the buyer decides to be refunded instead, BETTEREARTHFLOWERS.COM will refund the purchased price to the buyer. In no case will BETTEREARTHFLOWERS.COM refund more than the amount originally paid by the buyer. This guarantee will be valid so long as BETTEREARTHFLOWERS.COM is informed within thirty days (30 days) of the delivery date. BETTEREARTHFLOWERS.COM will not be responsible for flowers delivered to incorrect addresses, if there were errors in the information sent to BETTEREARTHFLOWERS.COM by buyers, or by anyone appointed by the buyers to enter the delivery instructions / information in his or her place, or for flowers delivered to the wrong address because of mistaken delivery information entered in the delivery instructions by the buyer or the person appointed by the buyer to enter the information in the website. Also, BETTEREARTHFLOWERS.COM shall not be responsible for loss of quality of the flowers sent due to absence of a recipient, or absence of someone at the recipients appointed place of delivery at the time of delivery to receive the flowers, or due to incorrect delivery information supplied in the online order to BETTEREARTHFLOWERS.COM, or to a “last minute” request to re-route the order or orders to a different location after the order or orders have been sent out to the original appointed place of delivery. Since there is only a limited number of FAIR TRADE certified farms in the world, BETTEREARTHFLOWERS.COM shall not be liable for involuntary errors caused by information that may show a product available in the website that may be sold out. If this occurs BETTEREARTHFLOWERS.COM will contact the buyer, by phone or e-mail, and suggest available alternatives of similar value, color and size, or the next possible available date of departure and delivery for the exact arrangement ordered, or will refund the full amount paid by the buyer. BETTEREARTHFLOWERS.COM, all its officers, employees, content or service providers including logistics companies hired by BETTEREARTHFLOWERS.COM to deliver flowers to the appointed address of deliveries do not warranty that the www.betterearthflowers.com website is an error-free website. If involuntary errors cause lack of accuracy in the information, software faults, content or service problems, viruses, or any other mistake, BETTEREARTHFLOWERS.COM, its officers, employees, content or service providers will only be liable for the value of the transaction in question. By accepting these Terms and Conditions we accept that BETTEREARTHFLOWERS.COM’s maximum liability will be no more than the purchase price of the transaction, and in no case will BETTEREARTHFLOWERS.COM, its officers, employees, content or service providers be liable for any direct, or indirect damages including, without limitation, lost profits that may result from mistakes, errors, viruses, defects, omissions, the correct or incorrect use of our website, or any technical problems that may result in interruption of the service, or in the malfunctioning of the software, or hardware that is used to operate. If an involuntary error does occur and a packing, delivery or any other mistake that has not been explicitly described above occurs and that our Guarantee Policy refers to clearly, by using our website you understand and agree to be legally bound by these Terms and Conditions and accept that BETTEREARTHFLOWERS.COM’s maximum liability will be no more than the purchase price of the transaction, and in no case will BETTEREARTHFLOWERS.COM, its officers, employees, content or service providers will be liable for more than that.
